In these Terms of Service, SAMUM is hereinafter referred to as the "Operator", "we", or "Pagenza.pl".
- Definitions
"Service" means the Pagenza.pl website, including the landing page builder, user panel, page editor, AI-driven content and layout generator, hosting of generated pages, lead collection mechanisms, form handling, email templates, and additional features provided within the platform.
"User" means any individual using the Service, including those who create an account, generate a page, use the builder before logging in, or manage a project.
"Client" means a User who has entered into an agreement with the Operator to use the Service, in particular by creating an account, activating a plan, or making a payment.
"Consumer" means a natural person entering into an agreement with the Operator for purposes not directly related to their business or professional activity.
"Sole Proprietor with Consumer Rights" means a natural person entering into an agreement directly related to their business activity, when the content of the agreement indicates that it does not have a professional character for that person.
"Project" means a landing page, associated page, draft version, published version, email configuration, forms, leads, content, files, and settings created or managed within the Service.
"User Content" means any materials provided, entered, uploaded, or generated by the User within the Service, including texts, prompts, business descriptions, photos, graphics, logos, files, contact details, offer contents, lead data, and page configurations.
"AI" means tools for automated generation or modification of content, appearance, code, page structure, graphics, emails, or other project elements.
"Landing page" means a public website created or hosted within the Service.
"Associated Page" means an additional page belonging to the same project or funnel, such as a sign-up confirmation page, thank-you page, resource access page, event confirmation, or any other next-step page.
- Scope of the Service
Pagenza.pl enables, in particular:
a. creating landing pages and associated pages,
b. generating content, layouts, and sections using AI,
c. editing generated pages,
d. publishing pages under a Pagenza.pl subdomain or, if the feature is available, under the User's own domain,
e. collecting leads via forms,
f. configuring emails related to forms and confirmations,
g. storing projects, versions, and selected settings,
h. using payment, technical, and communication integrations.
The detailed scope of features may depend on the selected plan, account status, technical limits, availability of integrations, and the current version of the Service.
The Operator may develop, modify, add, or remove features of the Service, provided that this does not violate the acquired rights of the Client resulting from an active, paid plan.
- Technical Requirements
To use the Service, the following are required:
a. a device with Internet access,
b. an up-to-date web browser supporting JavaScript, cookies, and secure HTTPS connections,
c. an active email address,
d. in the case of paid plans, a payment method supported by the payment processor.
The Operator is not responsible for issues resulting from incorrect configuration of the User's device, browser, network, domain, DNS, email, or external integrations beyond the Operator's control.
- Account Registration and Use of the Builder
The User may use selected features before creating an account, e.g., generating a project in the builder, if such a feature is available.
Access to the user panel, saving projects, publishing, payments, and management features may require creating an account or logging in.
The User agrees to provide true, accurate, up-to-date information that does not violate the rights of third parties.
The User is responsible for maintaining the confidentiality of their login credentials and for all activity on their account.
The User must immediately notify the Operator of any suspected unauthorized access to their account.
The Operator may refuse registration, block an account, or restrict access to the Service if the User violates the Terms of Service, the law, the security of the Service, or the rights of third parties.
- Rules for Using AI
The Service may use AI tools to generate pages, content, emails, styles, sections, code, and other elements. These tools operate based on external large language models provided by third parties.
All projects, landing pages, texts, graphics, code, and other elements generated using AI tools are created in a fully automated manner. The Operator has no influence over the final shape of the materials generated by the AI, does not verify them before presenting them to the User, and bears no responsibility for their content, accuracy, correctness, truthfulness, code security, fitness for a particular purpose, or for any errors, technical glitches, or so-called "hallucinations" of the artificial intelligence.
Source code, scripts, forms, and integration mechanisms generated by AI tools are purely illustrative and auxiliary. Due to the lack of direct visibility and editability of the source code by the User in the no-code model, the Operator exercises due diligence to ensure the security of the platform, but does not guarantee complete immunity of the automatically generated structures to errors, vulnerabilities, or advanced hacking attacks. The User uses AI tools at their own risk.
The User is solely responsible for verifying generated content and the functioning of forms before publishing or using them, particularly regarding compliance with applicable laws, truthfulness of information, copyrights, advertising and consumer protection rules, as well as regulated industry standards.
The User must not input any data, materials, or instructions into the Service that they do not have the legal right to process or use.
- User Content and Intellectual Property Rights
The User retains all rights to the User Content they independently input into the Service.
The User grants the Operator a non-exclusive, royalty-free, worldwide license to store, copy, technically modify, display, publish, transmit, and process User Content solely to the extent necessary to provide the Service.
The User declares that:
a. they hold the rights to the photos, graphics, logos, trademarks, texts, data, and other materials uploaded to the Service,
b. they have obtained consent from individuals whose image or data appear in the uploaded materials,
c. the User Content does not violate the law, good practices, or the rights of third parties.
The Operator may remove or restrict access to content that violates the Terms of Service, the law, third-party rights, the security of the Service, or the legitimate interests of the Operator.
The User is solely responsible for the content published on their landing pages, as well as for the products, services, offers, promotions, terms, privacy policies, and consents presented on their pages.
The User grants the Operator a royalty-free, perpetual, and geographically unrestricted license (with the right to sublicense) to use published projects and landing pages (including their names, screenshots, layouts, and content) for the Operator’s marketing, branding, and self-promotional activities. This right includes, in particular, displaying projects in the Operator’s portfolio, on its websites (including pagenza.com, pagenza.pl, pagenza.eu), on social media, in promotional materials, presentations, and case studies.
When using the integration with the Unsplash service to retrieve and place images in Projects, the User is obliged to comply with the current terms of the Unsplash License. The Operator provides this integration on an "as is" basis. The Operator is not responsible for the availability, quality, legality, copyrights, or model release rights of third parties depicted in images sourced from Unsplash, nor for any termination or modification of the terms of this integration by the third-party provider.
- Prohibited Content and Activities
The User shall not:
use the Service in a manner contrary to the law, these Terms of Service, or good practices;
publish unlawful content or content that violates copyrights, personal rights, trademarks, privacy, image rights, or trade secrets;
publish misleading, fraudulent, phishing, or spoofing content, or impersonate other individuals or entities;
promote illegal products or services, or those requiring permits that the User does not possess;
transmit malicious code, viruses, scripts, or content that disrupts the functioning of the Service;
circumvent security measures, limits, payment mechanisms, authorization, or technical restrictions;
engage in spamming, unsolicited communication, or unlawful email campaigns;
process personal data without an appropriate legal basis;
use the Service to violate consumer rights, advertising standards, personal data protection regulations, financial, medical, gambling, or other industry-specific regulations.
- Leads, Forms, and the Role of Pages in Data Processing
If the User collects personal data through the landing page, in particular lead data, the User is generally the Data Controller of such data within the meaning of the GDPR, as the User decides on the purpose and means of its collection and use.
In this capacity, the Operator acts as a Data Processor on behalf of the User, unless separate circumstances indicate otherwise.
The User is responsible for:
a. having an appropriate legal basis for processing lead data,
b. publishing appropriate data processing information (privacy notice) on their landing page,
c. obtaining required marketing consents, if necessary,
d. handling the rights of the data subjects,
e. ensuring forms, checkboxes, privacy policies, and email communications comply with applicable law.
The Operator processes lead data to the extent necessary to provide the features of the Service, including form submission logging, sending notifications, exporting data, technical analytics, and security.
Details regarding personal data processing are described in the Pagenza.pl Privacy Policy.
- Data Processing Agreement (DPA)
To the extent that the Operator processes personal data on behalf of the User as a Data Processor, these Terms of Service constitute a data processing agreement within the meaning of Art. 28 of the GDPR, unless the parties enter into a separate agreement.
The User entrusts the Operator with the processing of personal data for the purpose of providing the Service.
Categories of data subjects: Users, Client representatives, individuals filling out forms on landing pages, email recipients, individuals mentioned in the User Content.
Categories of data: identification data, contact details, form data, IP addresses, technical identifiers, activity data, message contents, and other data entered by the User.
Duration of processing: for the duration of the use of the Service and for the period necessary to fulfill legal, billing, complaint, security, and claims defense obligations.
The Operator:
a. processes data only on documented instructions from the User, unless required otherwise by law,
b. ensures that persons authorized to process the personal data have committed themselves to confidentiality,
c. implements appropriate technical and organizational measures,
d. uses sub-processors necessary to provide the Service,
e. assists the User in responding to data subjects' requests to exercise their rights, to the extent feasible and reasonable based on the nature of the Service,
f. upon termination of the Service, deletes or returns the data, unless applicable law requires retention,
g. makes available to the User information necessary to demonstrate compliance with Art. 28 of the GDPR within a reasonable scope.
The User grants a general authorization for the Operator to engage sub-processors, in particular providers of hosting, databases, email services, payments, AI tools, analytics, monitoring, customer support, and security.
- Page Publishing, Subdomains, and Domains
The User may publish landing pages under a subdomain provided by Pagenza.pl or under their own domain, if such a feature is available.
The Operator does not guarantee the availability of a specific subdomain until it is successfully reserved or assigned.
The Operator may refuse to provide, block, revoke, or reclaim a subdomain address at any time, in particular if it violates the law, third-party rights, personal rights, trademarks, good practices, these Terms of Service, the security of the Service, or in the event of account inactivity exceeding 6 months.
The User is responsible for configuring their own domain, DNS records, certificates, email, and technical settings, unless the Operator has explicitly agreed to perform such duties.
The Operator endeavors to ensure that free SSL certificates (HTTPS) are generated and renewed for published projects. However, the Operator does not guarantee uninterrupted operation of this mechanism and is not liable for interruptions in the availability of the User's pages caused by the lack or expiration of an SSL certificate, particularly due to incorrect DNS configuration by the User or failures of external certificate authorities.
- Payments, Plans, and Billing
Use of certain features of the Service may be subject to a fee.
Prices, plan features, limits, billing cycles, and promotional terms are presented within the Service or on the website prior to purchase.
Payments may be handled by an external payment processor. The Operator does not store full payment card details unless explicitly stated otherwise.
If a plan is subscription-based, the Client authorizes the recurring collection of fees in accordance with the selected plan until the subscription is canceled.
Failure to pay, chargebacks, expiration of the payment method, or exceeding limits may result in restriction, suspension, or termination of access to paid features.
The Operator may issue invoices or other billing documents in accordance with applicable regulations.
The prices listed may not include taxes, local duties, or fees charged by third parties, depending on the Client's place of residence, registered office, or tax status.
The Operator reserves the right to change subscription plan prices during their term for valid reasons, such as increased infrastructure maintenance costs, inflation, changes in tax rates, or expansion of the Service's features. For Clients with an active subscription, the Operator will notify them of the planned price change via email at least 14 days prior to the start of the next billing cycle. The updated price will apply from the new billing cycle. If the Client does not accept the new price, they have the right to cancel their subscription before the end of the current billing cycle. Failure to cancel the subscription before the new billing cycle constitutes acceptance of the new price.
- Right of Withdrawal
Consumers and Sole Proprietors with Consumer Rights may have the right to withdraw from a distance contract within 14 days, unless a statutory exception applies.
If the Client requests the supply of digital service/content to begin before the expiry of the withdrawal period and has been informed of the loss of the right of withdrawal upon full performance of the service, the right of withdrawal may expire in accordance with applicable regulations.
In the case of digital content or services not supplied on a tangible medium, the right of withdrawal may not apply once performance has begun with the Client's prior express consent and acknowledgment of the loss of the right of withdrawal, if required by law.
To withdraw from the contract, the Client should send an unequivocal statement to the email address: hello@pagenza.com.
The provisions of this section do not limit the mandatory consumer rights under the laws applicable in the Consumer's country of habitual residence.
- Complaints
Complaints regarding the Service can be submitted to the email address: hello@pagenza.com.
The complaint should include information identifying the User, a description of the issue, the date of occurrence, and the expected resolution.
The Operator will investigate the complaint within a reasonable timeframe, no later than required by applicable law.
The Operator may request additional information if necessary to resolve the complaint.
- Service Availability and Technical Maintenance
The Operator endeavors to ensure that the Service is available continuously and securely.
The Service may be temporarily unavailable due to technical maintenance, updates, outages, actions of external providers, attacks, overloads, force majeure, or other causes beyond the Operator's control.
The Operator may schedule technical maintenance and updates, striving to minimize their impact on Users.
The Operator does not guarantee that the Service will be error-free or uninterrupted, unless a separate Service Level Agreement (SLA) has been explicitly agreed upon.
- Liability
The Operator is liable to Consumers and Sole Proprietors with Consumer Rights in accordance with mandatory provisions of law.
To Users who are not Consumers or Sole Proprietors with Consumer Rights, the Operator's total liability under any title (including security breaches, system errors, data leaks caused by source code defects, or AI operation) is limited to actual direct damages and shall not exceed the amount of fees actually paid by the Client to the Operator in the 3 months directly preceding the event giving rise to the claim, unless the damage was caused intentionally.
The Operator is not liable for:
a. the content, offers, products, services, and actions of the User,
b. business decisions made based on AI-generated outputs,
c. lost profits, loss of revenue, or loss of data caused by the User's actions or external integrations,
d. legal violations resulting from the publication of User Content,
e. incorrect configuration of domains, DNS, email, or external tools,
f. actions of third-party providers beyond the Operator's control,
g. any errors, inaccuracies, security vulnerabilities, infringements of third-party rights (including copyrights and trademarks), or damages resulting from the publication or use of content generated by AI tools,
h. data breaches, unauthorized access to personal data (including lead data), security incidents, or any administrative fines or damage claims arising from errors, vulnerabilities, or security flaws in the code, forms, databases, or scripts generated by AI tools.
No part of these Terms of Service excludes liability that cannot be excluded under applicable law.
- Intellectual Property of Pagenza.pl
The Service, software, interface, trademarks, the Pagenza.pl name, graphic elements, databases, documentation, code, and the Operator's know-how are protected by intellectual property laws.
Using the Service does not transfer any intellectual property rights in the Service or its elements to the User.
The User shall not copy, reproduce, decompile, sell, sublicense, distribute, or use elements of the Service beyond the scope of permitted use.
- Suspension, Restriction, and Termination of Access
The User may terminate their use of the Service using the features available in their user panel or by contacting the Operator.
The Operator reserves the right to disable a User's landing page, suspend access to the Service, or immediately cancel an active subscription if:
a. the User violates these Terms of Service or the law,
b. the account or landing page is used for abuse, spam, phishing, fraud, or security violations,
c. payment outstanding occurs,
d. continued provision of the Service or operation of the page would expose the Operator, other users, or third parties to legal, financial, technical, or reputational risk.
Upon termination of the Service, data may be deleted after the technical, billing, legal, and security periods described in the Privacy Policy have elapsed.
The Operator also reserves a general right to cancel a subscription and terminate the Service for any project by giving 14 days' electronic notice (with a pro-rata refund of the fee for the unused portion of the billing cycle).
- Amendments to the Terms of Service
The Operator may amend these Terms of Service for valid reasons, in particular due to:
a. changes in legislation,
b. changes in the features of the Service,
c. technical, organizational, or security updates,
d. changes to the payment model,
e. the need to clarify existing provisions.
The Operator will notify Users of significant changes via the Service, email, or other appropriate means.
If a change significantly affects the Client's rights or obligations, the Client may terminate their use of the Service before the changes take effect, unless the change results from mandatory legal provisions.
- Governing Law and Jurisdiction
These Terms of Service are governed by Polish law, without prejudice to mandatory consumer protection laws in the consumer's country of habitual residence.
Any disputes with Users who are not Consumers or Sole Proprietors with Consumer Rights shall be resolved by the court having jurisdiction over the registered office of the Operator.
Consumers may use out-of-court complaint and redress mechanisms where provided for by applicable law.
- Language of the Documents
These Terms of Service are drafted in the Polish language.
The Operator may provide translated versions in other languages. Unless mandatory laws provide otherwise, translated versions are for convenience only, and for Polish Users, the Polish version is binding.
For users outside of Poland, the Operator may use the English version of the documents as the global version, subject to mandatory regulations in the consumer's country.
